Agua Fria Justice Court

 

The Agua Fria Justice Court is a court of limited jurisdiction. This means that it only handles civil traffic tickets, misdemeanor criminal charges, and civil matters where the amount in dispute is under $10,000.00. Agua Fria does not deal with felony criminal charges.

Civil and misdemeanor criminal tickets issued by the Maricopa County Sheriff’s Office, Arizona Department of Public Safety (DPS, or highway patrol), or Arizona Department of Transportation will wind up in Agua Fria if the violation occurred within the court’s jurisdiction.

A protective order can also be obtained at the Agua Fria Justice Court

The court’s jurisdiction encompasses mostly surface streets, although a small portion of the I-10 where it joins the loop 101 is in the court’s jurisdiction. Because this court’s jurisdiction does not cover much highway, we don’t see a lot excessive speed or other criminal traffic tickets out of this court.

In our experience, this court will consider allowing defensive driving school in excessive speed cases where the speed it not too egregious. Cases in this court are prosecuted by the Maricopa County Attorney’s Office (MCAO). Individual prosecutors with the MCAO often have their hands tied from a negotiation standpoint by office policies or having to run plea agreements through a senior supervising attorney. In general though, we have found the MCAO reasonable to work with.

The Agua Fria Justice Court is located in Maricopa County in metro Phoenix. The court is inside the Southwest Regional Court Center with several other courts. There is free parking outside the front of the courthouse.

Private Home Destroyed by the Police, City Not Liable

Police were pursuing an armed person who had allegedly shoplifted some merchandise from a wal-mart. The alleged shoplifter took refuge in a private home and a police standoff followed. Over the course of 19 hours, the police SWAT team “fired gas munition and 40-millimeter rounds through the windows, drove an armored vehicle through the doors, tossed flash-bang grenades inside and used explosives to blow out the walls,” according to a Washington Post article. By the time the police were done with the home, it had to be demolished. You can see why in the picture above.
